Driver Crash Into Motorcyclist Facing Felony Assault Charges 

A driver is now facing felony assault and other charges after colliding with a motorcyclist on the Sunset Highway. The incident occurred on Wednesday, June 26, 2024, at approximately 3:05 p.m. The injuries were determined to be non-life-threatening. The driver of a Subaru, identified as 60-year-old David J. Bumgardner from Beaverton, Oregon, reported no injuries.

Upon receiving a report of the crash involving a car and a motorcycle on eastbound Highway 26 at the Southwest Sylvan Road overpass, officers from the Portland Police Bureau’s Central Precinct swiftly responded to the scene. They discovered an overturned 2006 Subaru Legacy Outback and a downed 2016 Yamaha motorcycle. The motorcyclist sustained serious injuries and was promptly transported to the hospital via ambulance.

Both the PPB Traffic Division and the Major Crimes Team were called in to investigate the crash. Preliminary findings indicate that the motorcyclist was engaged in lane splitting, an illegal practice in Oregon. Bumgardner claimed that the motorcycle struck his car and continued without stopping. 

In response, Bumgardner pulled onto the shoulder and began pursuing the motorcyclist at high speed. However, when the motorcyclist slowed down for a traffic control sign, Bumgardner was unable to halt his vehicle in time, resulting in a collision that caused his car to overturn onto the motorcyclist. Fortunately, passersby came to the aid of the injured motorcyclist, lifting the vehicle to free them.

Following the incident, Bumgardner was taken into custody and booked into the Multnomah County Detention Center on charges including Assault in the Second Degree, Assault in the Third Degree, Reckless Driving, and Recklessly Endangering Another Person.

The motorcyclist, identified as 47-year-old Tha Ouk from Vancouver, Washington, was issued several citations, including Driving Uninsured, Careless Driving, Failure to Drive Within Lane, Driving without a Motorcycle Endorsement, and Failure to Register Motor Vehicle.
